  4. PLEASE READ THIS SOFTWARE LICENSE AGREEMENT "LICENSE" CAREFULLY BEFORE
  5. USING THE SOFTWARE. BY USING THE SOFTWARE, YOU ARE AGREEING TO BE BOUND
  6. BY THE TERMS OF THIS LICENSE. IF YOU DO NOT AGREE TO THE TERMS OF THIS
  7. LICENSE, PROMPTLY DESTROY ALL COPIES OF THE SOFTWARE.

  9. 1. License. The software accompanying this License whether on disk,
  10. in read only memory, or on any other media (the “Signature Software”)
  11. is licensed, not sold, to you by Signature Software Ltd. (“SSL”).
  12. SSL retains title to the Signature Software. The Signature Software
  13. in this package and any copies which this License authorizes you to
  14. make are subject to this License.

  16. 2. Permitted Uses and Restrictions. This License allows you to install
  17. and use the Signature Software on one Newton device and use it for 30
  18. days. Failure to pay the shareware fee within this time period
  19. constitutes termination of this license. Upon receipt of the shareware
  20. fee by SSL, this license agreement will be replaced by a similar license
  21. for an enhanced version of the Signature Software with no time limit.

  23. 3. Disclaimer Of Warranty. You expressly acknowledge and agree that
  24. use of the Signature Software is at your sole risk. The Signature
  25. Software is provided “AS IS” and without warranty of any kind and
  26. SSL EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED,
  27. INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY
  28. AND FITNESS FOR A PARTICULAR PURPOSE. SSL DOES NOT WARRANT THAT THE
  29. FUNCTIONS CONTAINED IN THE SIGNATURE SOFTWARE WILL MEET YOUR REQUIREMENTS,
  30. OR THAT THE OPERATION OF THE SIGNATURE SOFTWARE WILL BE UNINTERRUPTED OR
  31. ERROR-FREE, OR THAT DEFECTS IN THE SIGNATURE SOFTWARE WILL BE CORRECTED.
  32. FURTHERMORE, SSL DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING
  33. THE USE OR THE RESULTS OF THE USE OF THE SIGNATURE SOFTWARE OR IN TERMS
  34. OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. SHOULD THE
  35. SIGNATURE SOFTWARE PROVE DEFECTIVE, YOU (AND NOT SSL) ASSUME THE ENTIRE
  36. COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. THE LICENSE FEES
  37. FOR THE SIGNATURE SOFTWARE REFLECT THIS ALLOCATION OF RISK. SOME
  38. JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO
  39. THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

  41. 4. Limitation Of Liability. UNDER NO CIRCUMSTANCES INCLUDING NEGLIGENCE,
  42. SHALL SSL BE LIABLE FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES
  43. THAT RESULT FROM THE USE OR INABILITY TO USE THE SIGNATURE SOFTWARE, EVEN
  44. IF SSL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. In no event
  45. shall SSL's total liability to you for all damages, losses, and causes
  46. of action exceed the amount paid for this License.

  48. 7. Controlling Law and Severability. This License shall be governed by the
  49. laws of Canada and the Province of Alberta. If for any reason a court
  50. of competent jurisdiction finds any provision, or portion thereof,
  51. to be unenforceable, the remainder of this License shall continue in
  52. full force and effect.

  54. 8. Complete Agreement. This License constitutes the entire agreement
  55. between the parties with respect to the use of the Signature Software
  56. and supersedes all prior or contemporaneous understandings regarding
  57. such subject matter. No amendment to or modification of this License
  58. will be binding unless in writing and signed by SSL.
